Follow-up on News Story by Charles L. Sifers

The post from yesterday (Local Oklahoma DUI Lawyer in the News…….12/26/2007) referenced an interview I did with KFOR on Wednesday on ways to avoid a DUI this holiday season.  I’d like to add a slight - and it might even be a hyper-technical - clarification to this story.

Being arrested for DUI when you are not driving: This crime is called “Actual Physical Control of a Motor Vehicle While Under the Influence” or “APC”.  It is not actually called “DUI”.  However, this crime IS found in the DUI statute.  Although we do NOT suggest that a person - if he feels he has had too much to drive safely - go ahead and drive, as opposed to getting off the road, we want to emphasis that parking the car and staying in it while still in possession of the keys, will expose that person to this APC crime and all the consequenses of a DUI.

Our office is EXTREMELY grateful that KFOR offered to provide this information to it’s viewers.  Maybe - just maybe - there will be one less person who has to face all the problems of a DUI who saw that story and took some of our “tips” to heart.
